Truck driver faces jail term and fine for reckless driving

SIBU: A concrete mixer truck driver claimed trial at the Magisrates’ Court here today (April 28) to a felony charge of causing death by reckless driving.

When the nature of charge was read and explained to Cliverson Jonathan, 50, of Sungai Durin, through an interpreter, he understood but pleaded not guilty to it.

The charge stated that, as the driver of Nissan concrete mixer truck, he had driven the truck recklessly and caused the death of motorcyclist Benet Kawit, 39, at the traffic light of Jalan Tun Ahmad Zaidi Adruce on April 21 at about 9.45 am.

The offence under Section 41(1) of Road Transport Act 1987 provides for an imprisonment term of not less than five years and not more than 10 years as well as a fine of between RM20,000 and RM50,000, upon conviction.

Magistrate Oon Kork Chern who presided over the case fixed the pre-trial case management on June 22.

In the meantime, he granted the accused to be released on RM6,000 bail with two local sureties.

In addition, he ordered the accused’s driving licence to be impounded until the case is resolved.

The accused who was unrepresented, was ordered to be remanded in prison custody after he failed to furnish bail.
