KUCHING: Two individuals were each fined RM500 in default three weeks’ imprisonment by the Magistrates’ Court here today for stealing iron materials from a construction site.
Magistrate Nursyaheeqa Nadzwa Radzali meted out the sentence on Donald Lawan Baji, 29, and Catherine Ngaring, 30, after they admitted to committing the offence.
They were charged with committing theft at a construction site at Mile 12 near Jalan Puncak Borneo, at about 5.45 pm on February 26.
According to the charge, the duo had, in furtherance of their common intention, stolen iron materials belonging to a construction company.
The offence is punishable under Section 379 of the Penal Code, read together with Section 34 of the same Code, which provides for imprisonment of up to seven years, or a fine, or both.
Based on the facts of the case, the complainant, a construction site supervisor, saw two individuals taking iron materials from the site while he was in front of his house.
Investigation revealed that the stolen items were taken without the permission of the construction company, resulting in an estimated loss of about RM350.
Following the report lodged by the complainant, police carried out an operation and arrested the suspects on March 5 at about 10.45 am at a flat along Jalan Kuching-Serian in Siburan.
During the arrest, police also seized a Proton Wira car and a car key believed to be linked to the case.
The prosecution was conducted by Deputy Public Prosecutor, Muhammad Afiq Safly Nor Kazly. Both the accused were unrepresented.
