Two men fined, jailed a day in pub assault case

KUCHING: Two men were each sentenced to one day’s imprisonment and fined RM2,000, in default one month’s jail, by the Magistrates’ Court here today for beating another man during an altercation.

Magistrate Nursyaheeqa Nazwa Radzali handed down the sentence on Michael Tay, 40, and Wylin Jee, 26, after they pleaded guilty to the charge brought against them.

The offence is punishable under Section 335 of the Penal Code, read together with Section 34 of the same Code, which provides for imprisonment of up to four years and a fine of up to RM4,000, or both, upon conviction.

The duo were charged with voluntarily causing grievous hurt to 28-year-old victim at a pub along Jalan Permata at about 3:30 am on March 6.

According to the charge, the offence was committed in furtherance of their common intention by punching the victim on the face, chest and stomach.

Facts of the case revealed that the complainant was at the entertainment outlet together with his younger brother, mother, girlfriend and several friends when he discovered that his younger brother had been assaulted by several unidentified men.

As a result of the assault, the victim was rushed to Sarawak General Hospital for treatment after sustaining serious injuries and losing consciousness.

Police investigations later found that both the accused were at the premises when a dispute erupted involving a woman identified as the girlfriend of one of the individuals present.

The woman had approached one of the accused to request his phone number but the victim became angry and jealous after seeing her with the accused.

The victim then allegedly attempted to seize and smash a mobile phone belonging to the accused, leading to a scuffle.

During the altercation, the victim suffered serious injuries after being assaulted by both accused.

Following investigations, police arrested Michael Tay on June 20 in front of a premises at Trinity Hub Commercial Centre along Jalan Tun Jugah, while Wylin Jee was arrested during a raid at a café in Batu Kawa on June 17.

The prosecution was conducted by Inspector Nur Shafiqa Nyaie Ilin, whereas both the accused were unrepresented.
