KUCHING: Two men were each sentenced to 15 years in prison by the Sessions Court here today for the gang rape of two teenage girls, allegedly their friends, at a budget hotel in late January.
Azrin Dollah, 21, and Tajudin Mohd Kamri, 35, pleaded guilty to three charges under the Penal Code: Section 376(1), Section 376(2)(c), and Section 375B.
Judge Jason Juga ordered the prison sentences for each charge to run concurrently.
Azrin was also sentenced to four strokes of the cane, while Tajudin received six strokes.
In the meantime, Tajudin was charged under Section 376(2)(c) of the Penal Code, and Judge Noorhisham Mohd Jaafar imposed a sentence of 15 years’ imprisonment along with six strokes of the cane after he pleaded guilty to the offence.
Azrin also pleaded guilty under Section 376(1) of the Penal Code for raping the friend of the complainant’s child, and Judge Iris Awen Jon ordered the accused to be imprisoned for 12 years along with four strokes of the cane.
The court further ordered both men to pay RM3,000 in compensation to the victims. Failure to pay will result in an additional six months’ imprisonment.
According to the charge sheet, the offences were committed on January 30 at a hotel on Jalan Sekama. The accused raped the two victims, aged 14 and 16, without their consent.
Section 376(1) carries a maximum penalty of 20 years’ imprisonment and whipping. Section 376(2)(c) and Section 375B each carry a maximum of 30 years’ imprisonment, with the former also mandating whipping.
The court was informed that the father of the 14-year-old victim lodged a police report after being alerted by the 16-year-old victim. The teenagers disclosed they had been taken by the two men and sexually assaulted.
Subsequent police investigations led to the arrest of Azrin and Tajudin.
Facts presented to the court revealed that Tajudin raped the 14-year-old victim while she was asleep, in the presence of Azrin and the 16-year-old.
Simultaneously, Azrin, having been aroused, raped the 16-year-old victim despite her attempts to resist by pinching and pushing him.
Hotel check-in and check-out processes were recorded by CCTV.
A medical examination by a specialist in Obstetrics and Gynaecology confirmed the 14-year-old victim sustained a linear abrasion, indicating recent partial trauma.
The prosecution was handled separately by Deputy Public Prosecutors, Ruvinasini Pandian, Chuah Kai Sheng and Adriana Maisarah Mohd Farid.
The case was investigated by Inspector Nur Ain Wong Abdullah.
Both of the accused were unrepresented by counsel.
