KUCHING: A university student was sentenced to 15 years in prison and five strokes of the cane for raping his younger sister, resulting in her becoming pregnant and giving birth to a baby boy.
The 25-year-old accused, a final-semester Bachelor of Science student, pleaded guilty to a single charge read out before Judge Musli Abdul Hamid at the Sessions court today.
He was accused of raping his 23-year-old younger sister at their residence in a flat in Matang on Nov 14, 2024.
He was charged under Section 376B of the Penal Code, which carries a prison sentence of not less than 10 years and not more than 30 years, and may include whipping, if convicted.
According to the facts of the case, on Aug 15 last year, at around 10.30 am, the complainant, a medical officer, received a 23-year-old female patient.
The patient was experiencing abdominal pain, and upon examination, it was discovered that she was between 37 and 39 weeks pregnant.
When questioned by the medical officer, the patient stated that she had engaged in sexual intercourse with her brother.
The medical officer then lodged a police report for further action and investigation, which led to the arrest of the accused on Feb 28 in Kota Samarahan.
Investigations revealed that the accused and the victim had sexual intercourse at their residence.
The prosecution was conducted by Deputy Public Prosecutor, Asmawi Nur Haqim Mokhtar, while the accused was not represented by a lawyer.
The case was investigated by investigating officer, Inspector Mohammad Fadini Noni.
