KUCHING: A 22-year-old man was fined RM3,500, in default 10 months imprisonment, by the Magistrates’ Court here today for threatening to hurt his biological mother.
Magistrate Nursyaheeqa Nazwa Radzali imposed the fine on Shahriz Arman after he pleaded guilty to criminal intimidation under Section 506 of the Penal Code.
The court heard that the incident occurred at about 10:00 am on September 13 at a house in Kampung Sejingkat here.
Based on the facts of the case, the accused had allegedly threatened to punch his 49-year-old mother after she told him to stop shouting and raising his voice.
He then allegedly uttered threatening words and raised his hand as if attempting to punch her, causing her to feel frightened and concerned for her safety.
Investigation revealed that the accused had emerged from his bedroom in an angry state and raised his voice, although the complainant was unaware of what had caused him to behave that way.
It was understood his mother then told him not to shout or raise his voice as she was worried that the neighbours might hear the commotion.
The accused subsequently allegedly uttered threatening words, warning his mother to “be careful” as he would punch her, while raising his hand as if attempting to do so.
It was understood that the accused and the complainant were biological mother and son, with the accused being the eldest of two siblings.
Police arrested the accused at about noon on September 14 during an operation led by a team from the Kuching District Criminal Investigation Division.
Deputy Public Prosecutor, Muhammad Aidil Akmal Sharidan, prosecuted. The accused was unrepresented.
