Man imprisoned 14 months for injuring uncle

KUCHING: A man was sentenced to 14 months in prison, in default fined RM5,000, by the Magistrates’ Court here today for injuring his uncle while under the influence of alcohol.

Steven Linnya, 36, from Padawan, pleaded guilty to two charges read before Magistrate Nursyaheeqa Nazwa Radzali.

He was first charged under Section 323 of the Penal Code for voluntarily causing hurt to his 53-year-old uncle by kicking and punching him in the chest.

The offence carries a maximum penalty of one year’s jail, a fine of up to RM2,000, or both.

Steven was also charged under Section 506 of the Penal Code for criminally intimidating the same victim.

Both offences were committed at a house in a Padawan village at 2:00 am on October 26.

According to the facts of the case, the complainant was approached by his intoxicated nephew and was punched and kicked in the chest, resulting in injuries to his left elbow and abrasions on his back.

The accused also threatened the complainant not to report the incident to the police and made statements indicating he intended to kill him and throw him into a pond.

The complainant lodged a police report, which led to Steven’s arrest during ‘Ops Kesan’ on November 10.

Deputy Public Prosecutor, Chuah Kai Sheng, handled the prosecution, while the accused appeared in court unrepresented.
