Drug-positive man gets 40 months for house-breaking offence

KUCHING: A 34-year-old man was sentenced to 40 months’ imprisonment by the Magistrates’ Court here today (Feb 11) after pleading guilty to a house-breaking offence committed earlier this month.

Mohd Nurazan Mohamad Marwan entered his plea before Magistrate Ling Hui Chuan.

He was charged under Section 457 of the Penal Code, which provides for a jail term of up to 14 years and, for subsequent offences, may also include a fine or whipping.

According to the charge sheet, the offence took place at Jalan Dagok at about 7.50 pm on Feb 6.

Facts of the case stated that the complainant noticed a chair outside the house had been moved to the front window.

At the same time, the complainant saw Nurazan exiting through the window before jumping over the house fence.

The complainant then chased and managed to apprehend Nurazan along with an accomplice before contacting the police for further action.

Police later arrested Nurazan at about 8.09 pm on the same day.

Investigations revealed that the accused had entered the house without lawful purpose to commit the break-in.

A urine test conducted on him returned positive results for methamphetamine and amphetamine.

The prosecution was handled by Deputy Public Prosecutor, Ahmad Faizulufti, while Nurazan was unrepresented.
