Ex-husband gets seven years for hurting former wife

KUCHING: The Sessions’ Court here on Monday (Feb 23) sentenced a 53-year-old general worker to seven years’ imprisonment for intentionally causing hurt to his ex-wife with a knife earlier this month.

Judge Musli Ab Hamid ordered Morni Utek to serve the sentence from the date of his arrest on Feb 17 after he pleaded guilty to the charge read against him.

He was charged under Section 324 of the Penal Code, read together with Section 326A of the same Code.

Under Section 324, an offender is liable to imprisonment of up to 10 years, or a fine, or whipping, or any two of such punishments upon conviction.

Section 326A provides that, upon conviction, the offender may be punished with imprisonment for a term which may extend to twice the maximum term for the offence under the relevant section, notwithstanding any other punishment provided for that offence.

He committed the offence at about 12.25pm on Feb 17 at a flat unit in Jalan Setia Raja, where he injured his ex-wife using a knife.

Facts of the case revealed that the complainant, who is the victim’s daughter, noticed injuries on her mother’s right arm following an argument between the victim and Morni.

The daughter immediately lodged a police report and Morni was arrested on the same day.

Investigations revealed that Morni and the victim had been divorced for the past two years. During the argument, he injured his ex-wife with a kitchen knife.

A medical report confirmed that the victim suffered an incised wound on her right hand.

The prosecution was conducted by deputy public prosecutor Asmawi Nur Haqim Mokhtar while Morni was unrepresented.
