KUCHING: A 33-year-old man was fined RM4,000 by the Magistrate’s Court here for committing mischief by damaging a woman’s car during a road incident earlier this month.
Darrel Rengga Bantin was handed the sentence by Magistrate Ling Hui Chuan after he pleaded guilty of an offence under Section 427 of the Penal Code.
Under Section 427 of the Penal Code, the offence carries a penalty of imprisonment of up to five years, or a fine, or both.
He faces 10 months’ imprisonment in default if the fine is not paid.
According to the case facts, the incident occurred on March 16, at about 3.14pm along Jalan Taman Sri Perkasa.
The complainant was driving her Perodua Viva when a lorry cut into her lane and grazed the left side of her vehicle, causing scratches.
The situation escalated when the accused, who was driving the lorry, exited his vehicle and threw a hard object at the complainant’s car, striking and cracking the front windscreen.
The damage to the vehicle was estimated at RM430.
The victim later lodged a police report, leading to the arrest of the accused the following day at a factory in Kuching.
Investigations revealed that the act was intentional, and the accused was identified by the complainant, with supporting evidence obtained from dashcam footage.
The prosecution was conducted by Deputy Public Prosecutor Ahmad Fauzultfi Suriani. Darrel was unrepresented.
