KUCHING: A 39-year-old man was fined RM2,900, in default seven months’ imprisonment, by the Magistrates’ Court here today for having drugs in January this year.
Mohamad Saifullah Aduka pleaded guilty before Magistrate Ling Hui Chuan.
He was charged under Section 12(2) of the Dangerous Drugs Act 1952, punishable under Section 12(3) of the same Act, which provides for a fine of up to RM100,000, imprisonment of up to five years, or both, upon conviction.
According to the facts of the case, the offence was committed on Jan 29 at about 11.35am at a house in Taman Mesra Muara Tebas here, where Saifullah was found in possession of 0.05 grammes of methamphetamine.
The court was told that during an “Op Tapis Khas” operation, police officers raided the house and conducted a body search on him.
Saifullah was holding a small pouch in which a transparent plastic packet containing crystalline substances suspected to be methamphetamine was found.
He was immediately arrested at the scene.
A subsequent chemical analysis confirmed that the substance seized was 0.05 grammes of methamphetamine.
The prosecution was conducted by Ahmad Fauzulutfi Suriani.
