Man gets RM1,000 fine for damaging neighbour’s mailbox

KUCHING: The Magistrates’ Court on Tuesday (April 21) sentenced a 56-year-old man to a fine of RM1,000, in default two months’ imprisonment, for committing mischief by damaging his neighbour’s mailbox in Batu Kawa here last week.

Tan Kim Hua pleaded guilty to the charge framed under Section 427 of the Penal Code before Magistrate Nur Syaheeqa Nadzwa Radzali.

The court also ordered the accused to pay RM78.42 in compensation to the victim by Wednesday (April 22).

Failing to do so, he will serve an additional one month’s imprisonment pursuant to Section 432 of the Criminal Procedure Code.

According to the charge, Tan was accused of committing the offence at about 1.20am on April 17 at a house in Jalan Tondong, Batu Kawa.

He was found to have damaged a mailbox belonging to his neighbour, causing losses amounting to RM78.42.

Based on the facts of the case, the complainant reported that Tan, who is his neighbour, came to his house in an angry state and damaged the mailbox mounted on the fence, as well as shaking the front door grille.

The complainant stated that he did not know the reason for the accused’s actions.

Police later arrested Tan at about 10pm on the same day in front of a house along the same street.

Investigations confirmed that the accused had intentionally caused damage to the mailbox, leading to the losses incurred by the victim.

Deputy public prosecutor Muhammad Afiq Safly Nor Kazly appeared for the prosecution while the accused was unrepresented.
