Man fined RM2,000 for trespassing into a factory

KUCHING: A 38-year-old man was fined RM2,000 by the Magistrates’ Court here on Wednesday in default five months imprisonment for trespassing into a factory in the Samajaya Industrial Zone earlier this month.

Muhammad Ehsan Ahmad pleaded guilty to a charge under Section 448 of the Penal Code before Magistrate Nur Syaheeqa Nadzwa Radzali.

The offence carries a penalty of up to three years’ imprisonment, or a fine of up to RM5,000, or both upon conviction.

According to the charge, he was found to have committed lurking house trespass at about 4.40 pm on April 17 at an electronic manufacturer near Samajaya Industrial Zone here.

Based on the facts of the case, a complainant reported that he and several colleagues had chased two suspects believed to have taken transformer metal belonging to Sarawak Energy from the premises.

Muhammad Ehsan was successfully apprehended, while the other managed to escape.

In a separate report, police personnel on crime prevention patrol in the Tabuan and Bintawa sectors received instructions from the control centre to proceed to the location following information that members of the public had detained a suspect for alleged theft of metal.

Upon arrival, the complainant handed over the accused to the police, who then brought him to the Tabuan Jaya police station for further action.

Investigations revealed that the accused admitted to trespassing into the factory compound at the time of the incident.

The prosecution was conducted by Deputy Public Prosecutor Muhammad Afiq Safly Nor Kazly. The accused was unrepresented.
