Four jailed, fined over public fight

KUCHING: Four men were sentenced to seven days’ imprisonment and fined RM1,000 each, in default three months’ imprisonment, by the Magistrate’s Court here today for taking part in a public fight earlier this month.

Magistrate Leona Dominic Mojiliu imposed the sentence on Anderson Nyawin, 24, Bonny Mazwill Alo, 25, Alex Sendro Chai, 21, and Remyza Rika, 29, after they pleaded guilty to a charge of affray.

All four were charged under Section 160 of the Penal Code read together with Section 34 of the same Code for participating in a group fight at an eatery near Jalan Stutong at about 1.30am on May 21.

The offence carries a penalty of up to six months’ imprisonment, or a fine of up to RM1,000, or both, upon conviction.

Facts of the case revealed that the incident stemmed from a verbal altercation between the complainant and a group of men over the revving of a motorcycle engine.

The affray reportedly broke out spontaneously following the exchange of words, with multiple individuals engaging in a fight.

A police report was lodged following the incident and police later arrested all four accused.

The court also heard that the incident was believed to have been triggered by misunderstanding and provocation before all parties dispersed shortly after the altercation.

All four accused were unrepresented during the proceedings.
