Man fined RM7,500 for damaging two cars

KUCHING: A 52-year-old man was fined a total of RM7,500 by the Magistrates’ Court here yesterday (Jul 14) after pleading guilty to two separate charges of committing mischief by damaging vehicles.

Magistrate Leona Dominic Mojiliu meted out a RM5,000 fine, in default six months’ imprisonment, against Lim Teck Chong after he admitted to throwing a brick at a Proton Saga, causing RM1,200 in damages.

He was also fined RM2,500, in default four months’ imprisonment, for damaging another Proton Saga by kicking its rear light and breaking its windscreen wipers, causing losses estimated at RM120.

In the first case, Lim was charged under Section 427 of the Penal Code for committing mischief by throwing a brick at a Proton Saga belonging to a 42-year-old woman in front of a hotel here at 6.05 pm on July 5.

The act caused damage to the rear left side and front bonnet of the vehicle, resulting in losses amounting to RM1,200.

Based on the facts of the case, the complainant and her husband were preparing to park their vehicle when an unknown man approached and threw a brick at the car three times.

The complainant managed to record the man’s face using her mobile phone and later found that the vehicle had been dented at the rear left side and front bonnet.

Police subsequently arrested Lim at a bus stop along Jalan Abel here at 8.40 am on July 10.

In the second case, Lim was charged with damaging a Proton Saga belonging to a 63-year-old man at a hotel near Jalan Ang Cheng Ho here at about 4 am on May 2.

He had damaged the vehicle’s right rear light and windscreen wipers, causing an estimated loss of RM120.

The court heard that the damage was discovered by the complainant after being informed by his employee.

Closed-circuit television (CCTV) footage showed Lim kicking the vehicle’s rear light and breaking the front wipers.

Lim later admitted to damaging the vehicle without any reasonable cause, leading to the charge under Section 427 of the Penal Code.

Section 427 of the Penal Code provides for imprisonment of up to five years, or a fine, or both upon conviction.

Deputy Public Prosecutor Ahmad Fauzulutfi Suriani prosecuted both cases, while Lim was unrepresented.
