KUCHING: A 31-year-old licensed prisoner was sentenced to nine months’ jail by the Magistrates’ Court here today after pleading guilty to breaching the conditions of his parole licence by leaving his designated residence without permission.
Senior Assistant Registrar Abdurrahman Abrar Jami meted out the sentence on Mohd Ramadan Sedi, ordering the jail term to take effect from the date of his conviction, July 24.
Mohd Ramadan pleaded guilty to a charge under Section 43(4) of the Prison Act 1995, which provides for a fine of up to RM2,000, imprisonment for a term not exceeding two years, or both, upon conviction.
According to the charge, he failed to comply with the conditions of a licence issued to him by not residing at the designated house near Lorong Selang Ulu, Kuching, where he was required to stay while serving his licensed prisoner period.
The offence was committed at about 6.30 am on April 14, 2025.
The facts of the case revealed that Mohd Ramadan was serving a licensed prisoner release period from April 1 until June 18, 2025.
However, investigations found that he absconded from the supervision of the Kuching District Parole Office after leaving the designated residence on April 14 without lawful permission.
He failed to return to the residence, prompting a report to be lodged on April 16.
Police investigations established that the accused had breached the conditions of his licensed prisoner release by failing to reside at the approved address from April 14 to April 16, constituting an offence under Section 43(4) of the Prison Act 1995.
The prosecution was conducted by Deputy Public Prosecutor Mohammad Azeem Mohd Ridzo while the accused was unrepresented.
