KUCHING: An 18-year-old youth was ordered to perform 12 months of community service by the Magistrates’ Court here today for dishonestly retaining two stolen motorcycle rims.
Magistrate Nursyaheeqa Nazwa Radzali made the order after the accused previously pleaded guilty to an offence under Section 411 of the Penal Code.
The accused was ordered to carry out the community service after the Social Welfare Department (SWD) officer read the social report during the proceedings.
The court heard that the accused had dishonestly retained two motorcycle rims belonging to the 27 year old complainant, knowing or having reason to believe that the items were stolen property.
The offence was committed at about 8 am on May 24, at a seafood restaurant, Jalan Pending here.
According to the facts of the case, the complainant discovered that two motorcycle rims belonging to him were missing while he was at the premises.
The missing items included rims from a Yamaha Y15 motorcycle and a Modenas MRI motorcycle, with the total loss estimated at RM1,000.
Acting on information, police subsequently arrested the accused at about 7.34 pm on the same day at a petrol station along Jalan Setia Raja here.
Police also seized two motorcycle rims with tyres which were in the accused’s possession at the time of his arrest.
Investigations established that the items belonged to the complainant and were stolen property.
Deputy Public Prosecutor Muhammad Aidil Akmal Sharidan appeared for the prosecution. The accused were unrepresented.
