KUCHING: Two men were sentenced to eight months’ jail and fined RM3000 each, in default four months’ jail, by the Magistrates’ Court here yesterday for destroying cables by cutting them and threatening a complainant at a shop in Kubah Ria here.
Sharyl Nyzam Mohd Abu Husein, 38, and Nazrin Aqmal Ismail, 36, pleaded guilty to the charges, read before Magistrate Ling Hui Chuan.
For the offence under Section 431A of the Penal Code, the court fined each accused RM3,000, in default four months’ jail.
They were also each sentenced to eight months’ jail under Section 507B of the Penal Code, with the sentence taking effect from yesterday.
The court heard that at about 3.20 am on Sept 4, the complainant was informed by his colleagues that they had seen three unidentified men attempting to remove and cut cables outside CCK Fresh Mart, Kubah Ria branch near Matang Riverpoint Shopping at Jalan Matang, Petra Jaya.
The three men allegedly managed to flee with the cut cables belonging to TM and left the area in their respective vehicles.
The incident was recorded by the complainant on his mobile phone.
While the recording was being made, the suspects allegedly attempted to attack the complainant while uttering threats intended to cause him fear and deter him from taking action against them.
Police investigations later identified Sharyl and Nazrin as two of the three suspects allegedly involved in the incident, with the third suspect still at large.
Police from the Kuching District Police Headquarters Crime Investigation Division subsequently arrested the two local men and seized items believed to be connected to the case for further investigation.
Sharyl was found to have nine previous records involving various offences and drug-related cases while Nazrin had eight previous records involving various offences and drug-related cases.
Both also tested positive for amphetamine and methamphetamine in urine tests.
The prosecution was conducted by Inspector Siti Radhiah Abdul Rahman.
The case recently went viral after a video surfaced on social media showing three men attempting to steal cables and threatening the complainant.
Following the circulation of the video, Kuching police chief ACP Alexson Naga Chabu said police had arrested two of the suspects while another remained at large.
He said police also seized a blue Proton Iswara, a white Toyota Vios, a cable cutter and a set of car keys believed to be linked to the case.
