SIBU: A Bangladeshi construction worker was on Thursday sentenced to three months’ imprisonment by the Kapit Magistrate’s Court after pleading guilty to two criminal charges involving an assault and a death threat against a fellow worker at a hydroelectric project site.
The accused identified as Jaman, 31, admitted to voluntarily causing hurt and criminal intimidation during proceedings before Magistrate Romario Jonoi.
According to the first charge, Jaman was found to have voluntarily caused injury to another worker, identified as Md Rifat Ahmed at the Sinohydro Elektrik Projek Kem 3 construction site in Kapit at about 9:12 pm on May 24.
The offence falls under Section 323 of the Penal Code, which carries a punishment of up to one year’s imprisonment, a fine of up to RM2,000, or both, upon conviction.
For the second charge, he was accused of threatening to kill the same victim by uttering the words “I will kill him” with the intention of causing alarm.
The offence, framed under Section 506 of the Penal Code for criminal intimidation, is punishable with imprisonment of up to seven years, a fine, or both.
Investigation revealed that the incident stemmed from a dispute at the workers’ quarters of the hydroelectric project.
The victim alleged that Jaman, who was under the influence of alcohol, became aggressive and struck him with a clenched fist, causing injuries to his face.
Medical examination conducted at Kapit Hospital later confirmed that the victim sustained facial abrasions consistent with an assault.
Police arrested Jaman the following day at the parking area of a palm oil plantation camp in Kapit. No items were seized during the arrest.
After considering the accused’s guilty plea and the facts of the case, the court imposed a three-month jail sentence for each charge and ordered the custodial sentences for both offences run concurrently.
The sentence takes effect from the date of his arrest on May 25.
The prosecution was conducted by Inspector Chang Kok Siong, while the accused was unrepresented.
