KUCHING: A 29-year-old civil servant was charged in the Sessions Court here today with voluntarily causing hurt to his father using a PVC pipe.

The accused pleaded not guilty when the charge was read before Judge Iris Awen Jon.

He was charged under Section 324 of the Penal Code, read together with Section 326A of the same Code.

Under Section 324, the offence involves voluntarily causing hurt by means of a dangerous weapon or instrument. Upon conviction, the offence carries a jail term of up to 10 years, a fine, whipping, or any two of the punishments.

Section 326A provides for enhanced penalties when the offence is committed against a spouse, former spouse, child or other family member.

According to the charge, the accused allegedly injured his 52-year-old father using a PVC pipe at their family home near Jalan Merdeka, Petra Jaya, on June 3.

It is understood that the incident occurred while the accused’s parents were carrying out activities outside the house.

The incident is believed to have been triggered by the suspect’s dissatisfaction with the complainant’s refusal to help reconnect the electricity and water supply to the accused’s new house.

During the proceeding, Deputy Public Prosecutor Chuah Kai Sheng offered RM10,000 cash bail with two local sureties, and the accused is to report monthly at a nearby police station.

However, the court declined to grant bail after being informed that the accused was residing with his father, raising concerns over potential interaction between both parties.

In mitigation, the accused pleaded for leniency, stating that he is currently living with his father and expressed remorse for the incident.

He informed the court that he resides with his father and had discussed the matter with other family members, assuring the court that a similar incident would not recur.

The court has set July 8 for pre-trial case management and the accused was advised to engage legal counsel.

The case was investigated by Inspector Nur Ain Wong Abdullah.
