KUCHING: A 30-year-old man was fined RM1,400, in default three months’ jail, by the Magistrates’ Court yesterday for punching a 38-year-old man with an intellectual disability in the face.
Abang Fadhli Azree Abg Ramli pleaded guilty to the charge under Section 323 of the Penal Code before Magistrate Nursyaheeqa Nazwa Radzali.
He was charged with voluntarily causing hurt to the victim by punching him in the face, leaving him bruised.
The offence was committed inside a car at the Kota Sentosa Market car park between 5 pm and 5.30 pm on Sept 3.
The court heard that on the day of the incident, the victim’s younger sister, who was at her home in Simunjan, received a call from their mother informing her that her brother had been taken away by a man known as Jerry without their knowledge.
The victim was later brought home with bruises on his face.
When questioned by his mother, the victim said the accused had wanted to take his OKU identification card and photograph his face.
A scuffle subsequently broke out between the two before members of the public intervened and separated them.
The victim was then taken by his mother to a nearby hospital for treatment.
A police report was subsequently lodged, leading to the accused’s arrest on Sept 4 at an oil palm plantation in Simunjan.
Prosecution officer Inspector Siti Radhiah Abdul Rahman appeared for the prosecution while the accused was unrepresented.
