Foreign man fined RM1,500 for physical brawl with brother

KUCHING: A Pakistani man was fined RM1,500 or two months’ imprisonment in default by the Magistrate’s Court here yesterday (May 19) after pleading guilty to voluntarily causing hurt to his elder brother.

Magistrate Ling Hui Chuan meted out the sentence on 29 year old Ullah Abid after he admitted to the charge under Section 323 of the Penal Code, which carries a penalty of up to one year’s imprisonment, a fine of up to RM2,000, or both, upon conviction.

According to the charge, Ullah voluntarily caused hurt to his brother at Lorong Rubber here at about 4.30 pm on May 14.

Based on the facts of the case, the incident occurred after the two brothers became involved in an argument over business payment matters, which later escalated into a physical altercation.

During the scuffle, the accused punched and bit the complainant’s left arm and right-hand finger.

The complainant subsequently lodged a police report for further investigation.

Police from Satok Police Station arrested the accused at about 1.30 am on May 15.

Investigations revealed that the accused, who resided at a shoplot above a restaurant near Jalan Rubber Road 1, was the complainant’s younger brother and had acted aggressively during the dispute.

Medical examination findings confirmed that the complainant sustained soft tissue injuries to his left arm and right-hand finger.

The prosecution was conducted by Deputy Public Prosecutor Muhammad Afiq Safly Nor Kazly, while the accused was unrepresented.
