Habitual offender imprisoned after threatening to kill sister

KUCHING: A 39-year-old habitual offender was sentenced to 12 months’ imprisonment by the Magistrates’ Court here today for criminally intimidating his sister by threatening to kill her last month.

Azmanizzam Roslan pleaded guilty to the charge when it was read before Magistrate Ling Hui Chuan.

He was charged under Section 506 of the Penal Code, which defines criminal intimidation as threatening another person with injury to their body, reputation, or property with the intent to cause alarm.

The court ordered that the sentence take effect from the date of conviction, April 14.

According to the facts of the case, the offence occurred at about 4am on March 9 at a residence near Taman Sukma. The accused had threatened to cause death to his sister during a domestic altercation.

Investigations revealed that the incident was triggered by the accused’s anger over his missing car keys.

He accused both his sister and mother of taking them before issuing a verbal threat, saying, “If you take my car keys, I will kill you” (Mun kau ambik kunci kereta ya, aku bunuh kau). He also threatened to cause harm to other family members present.

Although no physical injuries were inflicted, the threat was deemed sufficiently serious to constitute criminal intimidation as it caused reasonable fear for the victim’s safety. The complainant reportedly experienced trauma following the incident.

Fearing for her safety, the sister lodged a police report, leading to the accused’s arrest the following day on March 10.

Further investigations established that the threat was not a mere outburst. The accused’s aggressive behaviour, coupled with his extensive criminal record, reinforced the seriousness of the offence.

Checks revealed that Azmanizzam is a recidivist with multiple prior convictions. He has eight previous offences between 2009 and 2021, involving drug-related crimes as well as property and violent offences.

Additionally, there were five past records where he had been convicted and sentenced for various offences.

Based on the investigation, the accused’s actions fulfilled the elements of criminal intimidation under Section 506 of the Penal Code, as the threat caused genuine fear to the complainant, who is his younger sister.

The prosecution was conducted by Inspector Nur Shafiqa Nyaie Illin while the accused was unrepresented.
