High Court rejects influencer’s appeal, upholds three-month jail sentence for theft

KUCHING: The High Court here dismissed the appeal of a social media influencer against her conviction for stealing RM668 from a beauty and spa centre last year.

Judge Leonard David Shim ruled to uphold the three-month jail sentence, which was imposed by the Magistrates’ Court on June 30, 2023.

Margaret Sherli Johari, 25, who was employed at the centre at the time, had appealed for a stay of execution, but her request was denied.

Leonard ordered that her sentence is to take effect Wednesday (Dec 18).

Deputy public prosecutor Ng Xiang Hua prosecuted the case, while Margaret Sherli was represented by counsel Margaret Theresa Udam.

Also present during the proceedings was observing counsel Rajesh Sethi, representing the company.

Earlier, Magistrate Syarifah Fatimah Azura Wan Ali sentenced Margaret Sherli to three months in prison on three counts under Section 381 of the Penal Code, which provides for imprisonment for up to seven years and a fine, upon conviction.

According to the charges, she is charged with stealing cash amounting to RM668 belonging to her employer’s company, between Nov 17, 2022 and March 14, 2023 at the centre along Jalan Laksamana Cheng Ho.

Magistrate Syarifah Fatimah sentenced her to three months’ imprisonment for the first charge and one months’ imprisonment for the second and third charges.

According to the case facts, the complainant, who is the shop owner, found that cash amounting to RM499 had been stolen on Nov 12, 2022.

Later, it was discovered that additional cash amounting to RM99 and RM70 had also been stolen.
