Man gets 12 months’ imprisonment for assaulting girlfriend

KUCHING: A man was sentenced to a total of 12 months’ imprisonment by the Magistrates’ Court here on Tuesday (Aug 18) for assaulting his girlfriend and damaging her identity card over a cheating allegation.

Magistrate Leona Dominic Mojiliu handed down the sentence after Griffin Nangkai Marshall Ayong, 35, pleaded guilty to both charges.

For the first charge under Section 323 of the Penal Code, the accused was sentenced to 10 months’ imprisonment.

He was sentenced to another 12 months’ imprisonment for the second charge under Rule 25(1)(d) of the National Registration Regulations 1990.

However, the court ordered both sentences to run concurrently, meaning the accused will serve a total of 12 months in prison.

The first charge under Section 323 of the Penal Code carries a maximum one-year jail term, a fine of up to RM2,000, or both upon conviction.

The second charge under Rule 25(1)(d) of the National Registration Regulations 1990 carries a maximum three-year jail term, a fine of up to RM20,000, or both upon conviction.

According to the facts of the case, the incident occurred at about 8pm on April 13 at a house in Jalan Kuap.

Griffin Nangkal had an argument with the 29-year-old complainant, who is the accused’s girlfriend, after accusing her of having a relationship with another man and making other allegations against her.

During the argument, the accused became aggressive and kicked the victim in the face, causing injuries to the right cheek and upper lip.

The accused also damaged the victim’s identity card by breaking it.

Following the incident, the victim lodged a police report, prompting an investigation by Padawan police.

Investigations found that the accused had caused injuries to the victim’s right cheek and upper lip and had also damaged her identity card. The prosecution was conducted by deputy public prosecutor Ahmad Fauzulutfi Suriani while the accused was unrepresented.
