KUCHING: The Magistrate’s Court here sentenced a 27-year-old man to six months in jail for possessing a stolen iPhone and disposing of a stolen luxury Bonia watch.
The convicted, Mohd Khairul Abdullah, pleaded guilty to two charges before Magistrate Syarifah Fatimah Azura Wan Ali.
According to the first charge, he is prosecuted under Section 414 of the Penal Code for deliberately disposing of a stolen Bonia branded watch belonging to a 32-year-old man.
Khairul committed the act at a house along Jalan Merdeka around 11.30am on Sept 4, 2021.
For that offence, Syarifah Fatimah sentenced the convicted to six months in prison.
Meanwhile, the second charge, he is accused of knowingly possessing a stolen iPhone 14 Promax phone belonging to a 22-year-old man in the car park at King Centre around 5.35pm on Dec 24, 2022.
Therefore, Khairul is charged under Section 411 of the Penal Code, which provides for a jail term of up to five years or a fine or both, if convicted.
Syarifah Fatimah sentenced the accused to five months in prison, in addition to setting both sentences to run concurrently.
According to the facts of the case, the two victims reported to the police that their house had been broken into and their valuables had been taken from their house.
The first incident happened on Aug 29, 2021 around 6am, the 32-year-old victim realised his house in Petra Jaya, had been broken into and some items were missing such as a Huawei phone and a luxury watch.
Meanwhile, the second incident, on Dec 21, 2022, the 22-year-old victim noticed that two of his phones placed near the bedroom window in his house in Petra Jaya, had been stolen.
The victim found his bedroom window open and a broomstick near the window.
Insp Nur Syafiqa Nyaie Ilin prosecuted while Khairul is unrepresented by a counsel.
