KUCHING: The Magistrates’ Court here today sentenced a 43-year-old man to seven months’ imprisonment for dishonestly receiving a stolen motorcycle engine last Wednesday (May 6).
Magistrate Ling Hui Chuan meted out the sentence on Mohamad Ridzuan Usup after he pleaded guilty to a charge under Section 411 of the Penal Code. He was unrepresented.
Section 411 of the Penal Code provides for a jail term of between six months and five years, as well as a possible fine, upon conviction.
The court ordered the jail term to take effect from today.
According to the charge, Ridzuan was found to have dishonestly received a stolen motorcycle engine at a house in Kampung Temenggong Haji Goeblit at about 11am on May 6.
He was charged with having reason to believe the engine, from a Modenas Kriss MJ110 motorcycle, was stolen.
Based on the facts of the case, the theft was first reported on Mar 27, 2024, when the complainant discovered that a motorcycle parked by the roadside near Sekolah Menengah Sains Kuching Utara along Jalan Matang had gone missing.
The motorcycle, was estimated to be worth RM5,000.
Acting on investigations, a police team led from the Sarawak contingent headquarters (IPK) raided a house in Kampung Temenggong Haji Gobil on May 6 this year.
During the operation, they arrested Ridzuan and seized a grey Modenas motorcycle bearing a false registration number.
Further inspection revealed that the engine matched that of the stolen motorcycle reported in the earlier case.
Investigations confirmed that the accused had in his possession the stolen engine at the time of arrest, leading to the charge against him.
