Schizophrenic man jailed eight years for assaulting father

KUCHING: The Sessions Court here sentenced a 30-year-old schizophrenic patient to eight years’ imprisonment after he pleaded guilty to causing grievous hurt to his father in an incident at their home in Krokong, Bau.

Judge Musli Abdul Hamid imposed the sentence after accepting a psychiatric report which confirmed that the accused, identified as Kyrie, was fit to stand trial.

Kyrie was charged under Section 326 of the Penal Code for intentionally causing grievous hurt, an offence punishable with up to 20 years’ imprisonment and liable to a fine or whipping upon conviction.

According to the charge sheet, the accused assaulted his 56-year-old father using a piece of wood at their residence in a village in Krokong at about 7:50 am on July 9.

Based on the facts of the case, the complainant was inside the house when he heard noises resembling objects being struck.

He later went outside and found his Perodua Viva car dented on the driver’s side, after it had been punched by the accused.

When the complainant advised his son calmly, the accused became aggressive, took a piece of wood and struck his father.

As a result of the assault, the complainant sustained serious injuries to his head and arm, as well as fractures to two toes. He received treatment at Bau General Hospital and subsequently lodged a police report.

Police arrested the accused on the same day, and investigations revealed that he had intentionally caused life-threatening injuries to the complainant by beating him with a piece of wood.

In mitigation, the court took into account the accused’s mental condition. Musli did not impose whipping, citing the accused’s mental illness.

The judge also advised the accused to comply with his medication schedule and to engage in beneficial activities provided in prison.

The prosecution was conducted by Asmawi Nur Haqim Mokhtar, while the accused was not represented by counsel.
