Slashing case ends with DNAA after brother withdrew report

KOTA SAMARAHAN: A man walked free after the Samarahan Magistrate’s Court here on Wednesday (May 6) granted him a discharge not amounting to an acquittal (DNAA) after the complainant withdrew a police report lodged against him.

Magistrate Shafiza Datuk Abdul Razak Tready made the order after the complainant informed the court that he no longer wished to pursue the case and formally withdrew the report.

The accused, Jong Chi Siong, 36, had been charged with voluntarily causing hurt to his brother by allegedly slashing him with a knife in an incident at Asajaya on September 13, 2023.

He was charged under Section 324 of the Penal Code, read together with Section 326A of the same Code.

Section 324 provides for imprisonment of up to 10 years, or a fine, or whipping, or any combination of the punishments upon conviction.

Meanwhile, Section 326A allows the court to impose up to twice the maximum sentence if the offence is committed against a family member.

Following the withdrawal of the report, the court ordered a DNAA and released the accused, who had been out on bail pending disposal of the case.

The prosecution was conducted by Mohd Fadzri Azham Zainudin, while Jong was represented by defence counsels, Russell Lim Jian Liang and Lai Eddy.
