Teen sent to Henry Gurney School for sexual offence

KUCHING: A 16-year-old teenage boy was ordered to be sent to the Henry Gurney School in Puncak Borneo for three years after pleading guilty to raping a 14-year-old girl.

Magistrate Nursyaheeqa Nazwa Radzali issued the order on Wednesday (March 4), stating that the sentence was in line with Section 91(1)(f) of the Child Act 2001, after taking into account the social report and advice from the court advisor.

The court heard that the accused committed the offence at a house in Petra Jaya here between June 2025 .

According to the facts of the case, the victim’s mother grew suspicious after noticing her daughter’s enlarged abdomen.

She brought the child for a medical examination at a specialist clinic on Dec 19, 2025, where the victim was confirmed to be 27 weeks pregnant .

A subsequent police report was lodged, leading to an investigation.

A medical specialist at Sarawak General Hospital later confirmed the victim was 30 weeks pregnant with an expected delivery date of Mar 16.

The accused was arrested on Jan 9 at the IPD Kuching One Stop Centre.

Investigation found that the statements from both the victim and the accused are consistent; the victim admitted to having intimacy with the accused, and the accused admitted to the act.

The victim was 13 years and 5 months old at the time of the incident.

For the offence under Section 376(1) of the Penal Code for rape, the accused could have faced imprisonment of up to 20 years and whipping .

However, due to his status as a child offender, the court proceeded under the Child Act 2001.

In addition to the three-year detention at Henry Gurney School, the court ordered the teenager to be placed under the supervision of a Welfare Officer for one year following his release.

The court also instructed his parents or guardian to visit him at the school at least once every two months, as required under Section 93(1)(d) of the same act .

The case was prosecuted by Deputy Public Prosecutor Muhammad Afiq Safly Nor Kazly, while the case was investigated by Investigative Officer Nur Ain Wong Abdullah. The accused was unrepresented.
