KUCHING: A 17-year-old teenage boy was ordered to be detained at the Henry Gurney School for three years by the Magistrates’ Court here today (Jun 16) after pleading guilty to raping a 13-year-old girl back in April.
Magistrate Ling Hui Chuan issued the order after considering the probation report from the Social Welfare Department (SWD).
The teenager was charged under Section 376(1) of the Penal Code, which carries a punishment of imprisonment for up to 20 years and whipping.
The offence took place on April 29 at 3.48 pm at a village near Jalan Bako.
The facts of the case showed that the complainant, who is the mother of the victim, reported to police at around 9.20 pm on the same day that she found the accused in her daughter’s bedroom.
The victim was 13 years old at the time of the incident.
The accused was arrested by a team of police officers from the Kuching District Criminal Investigation Department on May 4, 11.50 pm in Kampung Bako after the police report was lodged.
Investigations revealed that a medical report from Sarawak General Hospital found fresh full and partial tears on the victim’s private part.
During investigation, the victim stated that the accused had raped her on the day of the incident. The accused also admitted to the act and confirmed to commit such an offence.
The accused has no prior criminal record and tested negative for drugs.
Deputy Public Prosecutor Muhammad Afiq Safly Nor Kazly prosecuted the case. The accused was unrepresented.
