KUCHING: Two men have each been sentenced to three months’ imprisonment by the Magistrates’ Court here for criminal trespass into a private property on Valentine’s Day.
Magistrate Ling Hui Chuan handed down the sentence yesterday (Mar 3) after the accused were convicted under Section 447 of the Penal Code read together with Section 34 of the same Code. The jail term took effect from Mar 3.
The accused, Mohammad Syafiq Raba’ee, 28, and Muhammad Aziz Zakaria, 29, were charged with committing criminal trespass with common intention at a house in Regent Park here at 11.30 pm on Feb 14.
Section 447 of the Penal Code provides for imprisonment of up to six months, or a fine of up to RM3,000, or both, upon conviction.
According to the facts of the case, the complainant had gone to inspect his house with his nephew at about 11.30 pm when he noticed a motorcycle parked behind the gate.
He found that the gate had been pried open. Upon entering the house, he saw two men fleeing through a window. The accused did not manage to remove any property from the premises.
However, they left behind a motorcycle, a Modenas Kriss 110E, as well as a machete and several spanners.
Police investigations later led to the arrest of the two accused based on information traced from the abandoned motorcycle.
Both men admitted to trespassing into the house with the intention to commit an offence.
The prosecution was conducted by Deputy Public Prosecutor Ahmad Fauzulutfi Suriani.
