Youth jailed for house-trespass and theft

SIBU: A 23-old old youth was today (June 23) sentenced to 14 months’ jail by the Magistrates’ Court here for committing house-trespass and theft.

Magistrate Oon Kork Chern convicted Simon Brown from Jalan Oya on his own plea of guilty to the amended charge against him.

The charge stated that the accused had committed house-trespass by entering a house at Taman Desa Kemunyang belonging to Dayang Hadiah Awang Sepuan with intent to commit theft by taking one silver HP Laptop and one Vivo smart phone on June 9 at about 2.28 am.

Thereby, he had committed an offence punishable under Section 457 of the Penal Code which provides for an imprisonment which may extend to 14 years, upon conviction.

According to fact of the case, on June 9 at about 6 pm, when Dayang Hadiah (complainant) arrived home at Taman Desa Kemuyang, she discovered that her house gate had been tampered with.

She also noticed that the house window was no longer locked and showed signs of being pried open.

Upon inspection, she found that one of the rooms was rummaged and in a messy state and several items including the laptop and handphone missing, suspected to have been stolen.

Estimating her loss at RM3,700, she subsequently lodged a police report regarding the matter.

On the same day at 8.30 pm, following a tip off, a team of police led by ASP Labang Manggi arrested a local man in Sibu Jaya and seized from him several stolen items including a laptop and handphone.

The complainant was able to identify the stolen laptop and handphone as hers.

The case was prosecuted by ASP Siti Mariyah Dahari while the accused had no legal representation.
