SIBU: An elderly man was yesterday (Aug 12) sentenced by the Magistrates’ Court here to a fine of RM2,000, in default two months’ imprisonment, for punching an individual.

Magistrate Romario Jonoi convicted Ting Tet Chung, 63, from Jalan Meludam, after he pleaded guilty to the charge.

The charge stated that Ting had caused hurt to Wong Siew Mel near a mart outlet along Jalan Aman on July 14 at 4.20 pm.

The offence, under Section 323 of the Penal Code, carries a jail term of up to one year, a fine of RM2,000, or both, upon conviction.

According to the facts of the case, on the time of the incident, the complainant, Wong, had a misunderstanding with the accused.

Wong was puzzled as to why the accused was angry, as he had merely asked about an outstanding payment that had yet to be settled.

The accused then punched Wong on the mouth and nose. They were subsequently separated by the shop owner, who was present at the scene.

As a result of the incident, Wong suffered swelling and pain to his mouth and nose, and lodged a police report for further action.

Police investigations confirmed that the accused had punched Wong in the face. The dispute arose after Wong inquired about his unpaid wages, which the accused refused to pay.

The accused, who was unrepresented, opted to pay the fine.
