Indonesian gets six months’ jail, caning for illegal entry

KUCHING: The Sessions Court here sentenced an Indonesian man to six months in prison and two strokes of the cane for entering Malaysia without valid travel documents.

James, 26, from Sambas, Kalimantan Indonesia, pleaded guilty before Judge Zuraidah Zakaria to a charge read by a court interpreter.

He was charged under Section 6(1)(c) of the Immigration Act 1959/63 and punishable under Section 6(3) of the same Act for entering Malaysia without a valid permit.

Upon conviction, the offence carries a maximum fine of RM10,000, imprisonment of up to five years and up to six strokes of the cane.

The offence was committed at a café along Jalan Sungai Maong Tengah at about 4.20 pm on Aug 17.

Based on the case facts, the complainant and his team conducted an inspection at the café and approached James. During the inspection, he failed to produce any identification and did not have any valid documents.

Further checks found that there was no record of his entry in the Immigration Department database, confirming that he had entered Sarawak illegally.

Meanwhile, in the same court, an Indonesian woman was sentenced to five months in prison for a similar offence of entering Malaysia without a permit.

Yusnia, 30, pleaded guilty to the charge under Section 6(1)(c) of the Immigration Act 1959/63, punishable under Section 6(3) of the same Act.

She committed the offence at a café in Bandar Baru Samariang here at about 6.30 pm on Aug 17.

Deputy Public Prosecutor Mohd Fadzri Azham Zainudin prosecuted, while both Indonesians were unrepresented by counsel.
