The charge stated that they had dishonestly taken a Yamaha Lagenda 115Z (E) motorcycle belonging to Tong Tshiew Hua without her consent at Taman Damai, Tun Abang Haji Openg Road, on Aug 22 between 2.30pm and 3.02pm.

They were charged under Section 379A of the Penal Code, which provides for imprisonment of not less than one year and not more than seven years, as well as a fine, upon conviction.

According to the facts of the case, on Aug 22 at about 2.30pm, the complainant had parked and locked her motorcycle at Taman Damai, Tun Abang Haji Openg Road.
