Repeat drug offender gets five years, one stroke of cane

KUCHING: A 27-year-old man was sentenced to five years’ imprisonment and one stroke of the cane by the Sessions Court here on Tuesday (March 31) for repeated drug abuse involving methamphetamine.

Adzrul Zulkarnain Ariffin pleaded guilty before Judge Noorhisham Mohd Jaafar.

He was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39C(1)(b) of the same Act, for a repeat offence involving methamphetamine and amphetamine.

The court heard that the accused had two previous records under the same Section dated Jan 26, 2024.

For the latest offence, he was found to have again consumed drugs during his arrest and subsequent detention at the Narcotics Criminal Investigation Department (NCID), IPD Kuching at about 11.05am on Aug 21, 2025.

Under Section 39C(1)(b), repeat offenders are liable to imprisonment of not less than five years and not more than seven years, and up to three strokes of the cane.

Section 15(1)(a) provides for a fine of up to RM5,000 or imprisonment of up to two years, or both.

The court ordered the sentence to take effect from the date of arrest on Aug 28, 2025, and further ordered the accused to be placed under the supervision of the National Anti-Drugs Agency (AADK) for three years upon completion of his jail term.

Facts of the case showed that police detained the man, who was suspected of repeated drug use, and brought him to the police station for investigation.

Initial urine screening returned positive, while subsequent analysis by the Pathology Department of Sarawak General Hospital confirmed the presence of methamphetamine and amphetamine.

The case was prosecuted by deputy public prosecutor Adriana Maisarah Mohd Farid while the accused was unrepresented.
