KUCHING: A 30-year-old man was fined RM1,500 by the Magistrate’s Court here today (April 30) after he pleaded guilty to engaging in online gambling at a premises in Malihah Jaya, Jalan Matang Batu Kawa.
Magistrate Nursyaheeqa Nazwa Radzali imposed the fine on Mohd Affizul Jemali, with a default sentence of one month’s imprisonment if the fine is not paid.
According to the charge, the accused was found gaming in a public place using a mobile phone at about 9:50 pm on March 24, at an unnamed premises in Malihah Jaya.
He was charged under Section 7(2) of the Common Gaming Houses Act 1953, which provides for a fine of up to RM5,000, imprisonment of up to six months, or both, upon conviction.
Based on the facts of the case, a police team from the Padawan District Headquarters (IPD), conducted operations at the premises and identified themselves before approaching the accused, who was seated at a table.
A check on the man led to the discovery of a mobile phone containing elements of online gambling activities.
Police subsequently arrested the accused and seized several items believed to have been used in the illegal activity, including a Vivo mobile phone, a piece of paper bearing an ID and password, as well as RM30 in cash.
The suspect and the seized items were then brought to the police station for further action.
Deputy Public Prosecutor, Muhammad Afiq Safly Nor Kazly, prosecuted the case while the accused is unrepresented.
