Man gets 6 years for housebreaking, dodging police supervision

KUCHING: The Sessions’ Court here today sentenced a 37-year-old man to a total of six years’ jail for housebreaking and breaching a police supervision order.

Judge Musli Ab Hamid handed down the sentence against Mohammad Shafiq Jamali, after he admitted to both charges. He changed his plea during the pretrial case management.

For the first charge, Shafiq was sentenced to three years’ imprisonment from the date of arrest on Mar 30 for housebreaking under Section 457 of the Penal Code read together with Section 17 of the Prevention of Crime Act 1959 (POCA).

On the second charge, he received another three years’ imprisonment from the same date for breaching the terms of a police supervision order under Section 15(4) of POCA.

The court ordered both sentences to run concurrently.

According to the facts of the case, the complainant discovered that his mother’s house at Taman Padungan, Bukit Mata, had been broken into at about 12.45am on Mar 30. However, no items were reported missing.

Police later apprehended the accused at about 1.35am on the same day, hiding in the toilet of the house.

Investigations revealed that Shafiq was under a police supervision order for 15 months from Apr 17, 2025, to Jul 16, 2026 due to his involvement in multiple theft-related offences.

As part of the order, he was required to report to the police station every Monday and Thursday and remain at home between 8pm and 6am daily.

At the time of the incident, he had violated the order by leaving his residence without permission during restricted hours and committing housebreaking. He was caught red-handed at the scene.

During mitigation, the accused expressed remorse and requested that his sentence commence from the date of arrest, as well as to serve his imprisonment at Sri Aman Prison.

The prosecution was conducted by Deputy Public Prosecutor Asmawi Nur Haqim Mokhtar. The accused is unrepresented.
