SIBU: A 63-year-old commercial bus driver was fined RM8,000 by the Magistrates’ Court here on Thursday (July 2) after pleading guilty to driving without due care and attention, resulting in a collision with a motorcyclist along Jalan Tunku Abdul Rahman here earlier this year.

The accused, Ismail Mohamad, from Jalan Mendu, Kuching, admitted to committing the offence under Section 43(1) of the Road Transport Act 1987 which provides for a fine of between RM5,000 and RM10,000 and liable to imprisonment of up to 12 months upon conviction.

The court also ordered an eight-month jail term in default of payment, with the conviction to be endorsed on his driving licence.

According to the facts of the case, the accident occurred at about 11:00 am on January 26 along Jalan Tunku Abdul Rahman near Mile 8.

Investigations revealed that Ismail was driving a commercial bus when he overtook a motorcycle travelling in the left lane.

As he attempted to merge back into the same lane, the rear left side of the bus collided with the motorcycle.

The impact caused the motorcyclist, identified as Tiong Sing Chiong, to lose control of his Honda motorcycle before skidding off the road and crashing onto the left shoulder.

Police investigations found that the collision was caused by the accused’s failure to exercise due care and attention while operating the commercial vehicle, thereby endangering other road users.

The case was prosecuted by DPP Nuralisa Natasha Nazrulzam before Magistrate Romario Jonoi.

The accused paid the fine.
