KUCHING: A 40-year-old Thai national was sentenced to eight months’ imprisonment by the Magistrates’ Court here today for trespassing into a factory in Jalan Bintawa here.
Magistrate Ling Hui Chuan imposed the sentence on Yuthana Phatkong, who was also ordered to be referred to the Immigration Department of Malaysia upon completing his prison term.
The accused pleaded guilty to a charge under Section 448 of the Penal Code, which carries a maximum penalty of three years’ imprisonment, a fine of up to RM5,000, or both upon conviction.
According to the charge, Yuthana unlawfully entered a building belonging to a construction and advertising supplier company near Kuching Town Land District (Industrial Warehouse), at about 9:15 pm on May 30 with the intention of committing an offence.
The facts of the case revealed that a company representative lodged a police report after discovering the accused inside the factory building without permission.
A police team subsequently arrested Yuthana at the premises.
Investigations established that the accused, a Thai national who had been staying at an abandoned factory along Jalan Daya, Bintawa, had trespassed into the company’s premises without authorisation.
Deputy Public Prosecutor, Muhammad Afiq Safly Nor Kazly, prosecuted the case. Yuthana was unrepresented.
