Man jailed 10 months for retaining stolen motorcycle

KUCHING: A 35-year-old man was sentenced to 10 months’ imprisonment by the Magistrates’ Court here today after pleading guilty to dishonestly retaining a stolen motorcycle.

Magistrate Ling Hui Chuan imposed the sentence on Mohd Affiq Drahman under Section 411 of the Penal Code, which provides for imprisonment of between six months and five years, and a fine, where the stolen property is a motor vehicle or a component part of a motor vehicle.

According to the charge, Mohd Affiq was found dishonestly retaining a stolen Honda motorcycle belonging to a female complainant.

The offence was committed at about 1.15 pm on July 15 at a house along Jalan Intan here.

Based on the facts of the case, a police team from the Kuching District Police Headquarters (IPD) Criminal Investigation Department went to the house to apprehend Mohd Affiq, who was wanted in connection with another matter.

While carrying out checks at the premises, police inspected a black and orange Honda motorcycle parked outside the house, which was later found to be a false registration plate.

Further checks through the police MCAD system using the motorcycle’s chassis number revealed that the vehicle had been reported stolen in a case registered under Satok police report.

Investigations also confirmed that the motorcycle’s chassis number matched that of the stolen motorcycle owned by the female complainant.

Mohd Affiq was subsequently arrested and the motorcycle was seized before both were taken to the Kuching IPD for further investigation, which led to him being charged with dishonestly retaining stolen property under Section 411 of the Penal Code.

The prosecution was conducted by Deputy Public Prosecutor Muhammad Afiq Safly Nor Kazly. Mohd Affiq was unrepresented.
