KUCHING: A 23-year-old man was sentenced to 15 months in prison by the Magistrate’s Court here today for punching his father during an altercation at their home in Batu Kitang.
Magistrate Leona Dominic Mojiliu imposed the sentence on Idharhasmil Ismuni after he pleaded guilty to voluntarily causing hurt to his 64-year-old father.
The court ordered the accused to serve the 15-month sentence from the date of conviction.
He was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.
The court heard that the offence was committed at about 11:30 pm on July 25 at a house in Batu Kitang Jaya, Jalan Batu Kitang.
According to the facts of the case, the accused had returned home in an intoxicated state, walking unsteadily.
His father reprimanded him over his behaviour, causing the accused to become angry and aggressive.
Upon hearing the commotion, the victim’s fifth child attempted to intervene and calm the accused down.
However, the situation escalated into a struggle between the accused and his father, during which the accused punched the victim’s left arm and shoulder, causing him significant pain.
The victim subsequently lodged a police report.
A medical examination later confirmed that the victim had sustained a soft tissue injury to his left shoulder following an alleged assault by his son.
Deputy Public Prosecutor, Mohammad Azeem Mohd Ridzo, appeared for the prosecution. The accused was unrepresented.
