Man jailed 11 months for beating wife

KUCHING: A man, who beat his wife over a cheating allegation, was sentenced to 11 months’ jail by the Magistrates’ Court here today.

Magistrate Nursyaheeqa Nazwa Radzali sentenced 37-year-old Rito Rusaini after he pleaded guilty to the charge under Section 323 of the Penal Code, read together with Section 326A of the same code.

Under Section 323 of the Penal Code, if convicted, the accused will be punished for a term of up to one year, fined up to RM2000 or both.

According to the charge, Rito was found to have beaten his 28-year-old wife by pushing, punching and kicking her  at the roadside of Kampung Tabuan Melayu on January 31 at 6.30 pm.

She immediately lodged a police report and the accused was subsequently arrested.

During the incident, while his wife was travelling on a motorcycle, the accused had also obstructed her path.

Rito then grabbed her by the neck and pushed her, causing her to hit the metal road divider.

The argument arose after Rito suspected that his wife was having a relationship with another man.

The incident was also witnessed by a child of his wife’s friend, who was present at the scene.

The medical report confirmed that the wife sustained soft tissue injuries to the left neck, left sternum and right wrist.

Therefore, the accused had committed an offence punishable under Section 323 of the Penal Code, read together with Section 326A of the same Code.

The case was prosecuted by Deputy Public Prosecutor Muhammad Aidil Akmal Sharidan while Rito was unrepresented.
