KUCHING: An Indonesian man was fined a total of RM21,800, in default eight months’ imprisonment, by two separate courts here today (April 17) after pleading guilty to charges of overstaying and involvement in illegal lottery activities.
Jaisen Mahendra, 19, admitted to both offences, which were heard before Judge Musli Abdul Hamid and Magistrate Nursyaheeqa Nazwa Radzali.
For the immigration offence, he was charged under Section 15(1)(c) of the Immigration Act 1959/63, punishable under Section 15(4) of the same Act, for overstaying his visit pass.
The court imposed a fine of RM20,000, or six months’ imprisonment in default.
In a separate proceeding, he was charged under Section 9(1) of the Common Gaming House Act 1953 for purchasing illegal lottery tickets.
Magistrate Nursyaheeqa fined him RM1,800, or two months’ imprisonment in default.
According to the facts of the case, the accused was arrested at a grocery shop in King Centre, Jalan Simpang Tiga, at about 2:00 pm on April 5 while purchasing illegal lottery tickets.
Further checks revealed that his visit pass had expired on April 6, 2024, and he had overstayed in the country for approximately two years.
Investigations also found that he had been involved in illegal lottery purchasing activities during his stay.
The prosecution was handled by Deputy Public Prosecutors, Muhammad Afiq Safly Nor Kazly and Asmawi Nur Haqim Mokhtar.
The accused was not represented by counsel.
