Man fined RM10,000 for allowing bank account to be used in scam

KUCHING: A 22-year-old man was fined RM10,000, in default two months imprisonment, by the Magistrates’ Court here today for allowing another person to use his bank account, which subsequently received RM10,000 linked to a scam.

Magistrate Ling Hui Chuan imposed the fine on Dominic Unya Dunggat after he pleaded guilty to a charge under Section 424C(1) of the Penal Code.

Dominic was charged with indirectly allowing the use or control of his CIMB Bank account without lawful purpose, resulting in three transactions totalling RM10,000 being transferred into the account.

The offence was committed between 11:35 am and 11:47 am on July 25, 2025, at a premises in Jalan Angsana 7, Kuching.

According to the facts of the case, the complainant was allegedly deceived by an unidentified individual posing as a relative from China through a WhatsApp phone call.

Believing the caller was his relative, the complainant agreed to lend RM10,000 and subsequently transferred the money online into Dominic’s CIMB Bank account in three separate transactions.

The transactions were RM4,950 at 11:35 am, another RM4,950 at 11:45 am, and RM100 at 11:47 am.

The complainant later realised he had been deceived and lodged a police report.

Police investigations subsequently identified Dominic as the account holder who had indirectly allowed another person to have possession or control of his bank account without lawful authority.

During investigations, Dominic claimed that sometime in 2025, he had handed over his CIMB Bank ATM card to an old friend who had worked with him at an ice factory.

However, he was unable to provide the friend’s full details.

Deputy Public Prosecutor, Muhammad Afiq Safly Nor Kazly, appeared for the prosecution, while Dominic was unrepresented.
