KUCHING: The Magistrates’ Court here on today (April 20) sentenced a 33-year-old man to eight months’ imprisonment for stealing a motorcycle four years earlier.
Magistrate Nur Syaheeqa Nadzwa Radzali meted out the sentence to Mohamad Jalil Sidek Bakar after he pleaded guilty to a charge under Section 411 of the Penal Code.
The section provides for imprisonment of up to five years, a fine, or both upon conviction.
According to the facts of the case, the offence took place at about noon on March 15, 2022, in Jalan Matang, where the accused was found in possession of a grey Yamaha motorcycle believed to be stolen.
The court heard that the complainant discovered his motorcycle missing at about 5.30am on Feb 15, 2022, and lodged a police report soon after.
About a month later, a police team from the Criminal Investigation Department of the Sarawak Police Contingent Headquarters arrested the accused during an intelligence-led operation targeting stolen motorcycles after he was seen riding the vehicle in a suspicious manner.
Police seized the motorcycle along with its key, and investigations later confirmed that it belonged to the complainant, who subsequently identified it.
The case was prosecuted by deputy public prosecutor Muhammad Afiq Safly Nor Kazly while the accused was unrepresented.
