KUCHING: A duo were each sentenced to three months’ imprisonment by the Magistrate’s Court here today for committing trespassing in an attempt to steal mangoes from a house in Kampung Semariang Baru, Petra Jaya.
Senior Assistant Registrar, Abdurrahman Abrar Jami, imposed the sentence on Muhamad Suhaimi Ikhwan, 38, and Muhammad Haiqal Haizam, 25, after they pleaded guilty to the charge under Section 447 of the Penal Code, read together with Section 34 of the same Code, for committing criminal trespass with common intention.
Under Section 447, the offence is punishable with imprisonment of up to six months, a fine of up to RM3,000, or both, upon conviction.
The court ordered the jail term to commence from the date of conviction.
According to the charge, the duo was unlawfully entered the compound of a house at Jalan Cenderawasih, Kampung Semariang Baru, Petra Jaya, at about 3:15 am on July 17 with the intention of committing theft.
The case facts revealed that the homeowner was awakened after the house’s CCTV alarm system was triggered.
Upon reviewing the CCTV footage, he saw two suspicious men standing beneath a mango tree in front of his house.
When the suspects realised they had been spotted, they attempted to flee on two motorcycles.
The complainant managed to block one of the motorcycles, resulting in a struggle with one of the suspects.
After returning towards his house, he noticed another suspect climbing down from the roof using a pillar at the side of the house before escaping.
Both suspects fled the scene, leaving behind the two motorcycles.
Police later arrested Suhaimi at the Kuching District Police Headquarters at about 3:45 pm on the same day.
Following information provided by him, officers arrested Haiqal at the roadside along Lorong Petra Jaya 3 at about 4:30 pm.
Investigations found that the pair had entered the complainant’s property and attempted to steal mangoes from a tree within the compound but failed after being confronted by the homeowner.
The two motorcycles believed to have been used during the incident were also seized as part of the investigation.
The prosecution was conducted by Deputy Public Prosecutor, Mohammad Azeem Mohd Ridzo.
Both accused were unrepresented.
