SIBU: A 33-year-old man was sentenced to a one-year imprisonment and fined RM3,000 by the Magistrates’ Court today after pleading guilty to stealing a motorcycle from the parking area of Sibu Central Market earlier this year.
Shaufil Oudil Ismady from Jalan Sentosa, off Jalan Salim, here admitted to committing the offence under Section 379A of the Penal Code, which provides for a jail term of between one and seven years and also allows for the imposition of a fine.
According to the facts presented in court, the incident occurred on March 19 at approximately 11:37 am at the motorcycle parking area along Jalan Channel.
The accused unlawfully took a white Yamaha brand motorcycle, belonging to Hanim Junaidi, without the owner’s consent.
Investigations revealed that the victim had parked the motorcycle earlier that morning and inadvertently left the key in the seat lock cylinder. Upon returning around noon, he discovered that the motorcycle had disappeared before lodging a police report.
Police later arrested the accused and during investigations, he led officers from the Criminal Investigation Department (CID) to locations connected with the offence.
Acting on information provided by the accused under Section 27 of the Evidence Act 1950, investigators were also taken to the parking area where the motorcycle had been stolen and to another location linked to the disposal of stolen motorcycles.
Following his guilty plea, the court ordered Shaufil to serve a one-year imprisonment commencing from the date of his arrest. In addition, he was fined RM3,000, with a further three months’ imprisonment in default of payment.
The case was prosecuted by DPP Keshava Rao Tharma Raja before Magistrate Oon Kork Chern.
The accused, who has no legal representation, failed to pay the fine.
