KUCHING: A public servant from a local council was fined RM5,000, in default 11 months’ imprisonment, by the Magistrate’s Court here today after he was found guilty of consuming dangerous drugs.
Magistrate Nursyaheeqa Nazwa Radzali convicted Ramzi Rajak, 45, following a full trial after ruling that the prosecution had successfully proven its case beyond reasonable doubt.
A total of five witnesses appeared for the prosecution and one witness appeared for the defence during the trial.
The court also ordered Ramzi to undergo police supervision for two years upon serving his sentence.
Ramzi was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952 for consuming methamphetamine and amphetamine without lawful authority.
Under Section 15(1) of the Act, the offence carries a fine of up to RM5,000 or imprisonment of up to two years.
In addition, offenders are required to undergo supervision by an authorised officer for a period of between two and three years under Section 38B of the Dangerous Drugs Act 1952 after serving their sentence.
The offence was committed at about 11:00 pm on June 2, 2020, at the Narcotics Criminal Investigation Department office in Padawan.
According to the facts of the case, Ramzi was detained by a team from the Padawan District Police Headquarters Narcotics Criminal Investigation Department (NCID) before being brought to the department’s office to undergo a urine screening test.
The initial screening returned positive results for amphetamine and methamphetamine, leading to his arrest under Section 15(1)(a) of the Dangerous Drugs Act 1952.
A police report was subsequently lodged in connection with the arrest.
His urine sample was later sent to the Pathology Department of Sarawak General Hospital for laboratory analysis.
A chemistry report dated June 22, 2020, confirmed the presence of amphetamine and methamphetamine, both of which are listed as dangerous drugs under the First Schedule of the Dangerous Drugs Act 1952.
Deputy Public Prosecutors, Ahmad Fauzulutfi Suriani and Adriana Maisarah Mohd Farid, appeared for the prosecution, while the accused was represented by counsel, Abdul Rahman Mohamad Hazmi.
